Terms of Use

1. Operating entities
"Drive Shyft" means IOT Projects (Pty) Ltd. All rights, protections, indemnities, releases and limitations in these terms apply to the company and to its directors, employees, contractors and agents.
2. Platform "as is"
The platform is provided on an "as is" and "as available" basis. We make no warranty of uptime, accuracy of listings, fitness for any particular purpose, or successful placement of any driver with any fleet.
3. No liability
To the maximum extent permitted by South African law, Drive Shyft (both operating entities) accepts no liability for any loss or damage — direct, indirect, consequential, special, incidental or punitive — arising from use of the platform or from any agreement between users. There is no financial cap on this exclusion; it is subject only to mandatory consumer-protection minimums under the Consumer Protection Act (CPA) and the Protection of Personal Information Act (POPIA).
4. Mutual indemnity
Each user indemnifies both operating entities (and each of their directors, employees, contractors and agents) against any third-party claim, loss, damage, fine, penalty or legal cost arising from that user's use of the platform or that user's conduct toward other users.
5. Acceptable use
- No fraudulent or altered documents.
- No harassment, abuse or discriminatory conduct toward other users.
- No off-platform circumvention designed to avoid the per-placement success fee or the Premium subscription.
- No sharing of account credentials.
- No use of the platform that breaches the terms of any e-hailing platform (Uber, Bolt, inDrive, Yango or others).
6. Suspension and termination
Drive Shyft may suspend or terminate access at its sole discretion for breach, fraud, safety concerns, or platform abuse. No refund of the success fee is given once the 7-day cooling-off window has lapsed and the introduction has been captured.
7. Fees
Every new fleet owner receives a 30-day Premium trial on registration. After the trial, fleet owners may either remain on the Free plan (no monthly subscription, capped feature set, R699 per-placement success fee) or subscribe to Premium at R199 per month (full feature set and a discounted R399 per-placement success fee). The per-placement success fee is payable each time a fleet owner unlocks a specific driver's contact details to onboard them. Each success fee has a 7-day cooling-off window during which the fleet owner may cancel the introduction free of charge; after that period the fee is captured and is non-refundable. Drivers are never charged.

See our Privacy Notice for a full description of how personal information is handled. Lawful basis is consent (POPIA s.11(1)(a)) combined with contract performance and legitimate interest in operating the platform.
9. Third-party platforms
Drive Shyft has no affiliation with Uber, Bolt, inDrive, Yango or any other e-hailing platform. Use of those platforms is governed entirely by each platform's own terms, and Drive Shyft is not responsible for activation, deactivation, payments, or any other decision those platforms make about a user.
10. Governing law
These terms are governed by the laws of the Republic of South Africa.
11. Dispute resolution — AFSA arbitration only
Any dispute between a user and either operating entity that cannot be resolved by good-faith negotiation within 30 days will be referred to final and binding arbitration administered by the Arbitration Foundation of Southern Africa (AFSA) under its Expedited Rules, seated in Johannesburg, conducted in English, before a single arbitrator. Each party bears its own costs unless the arbitrator orders otherwise. Either party may approach a court only for urgent interim relief pending arbitration.
12. Changes to these terms
Drive Shyft may update these terms on 14 days' notice via the platform. Continued use after that period constitutes acceptance, and re-consent may be required.
